The general conditions of sale described below detail the rights and obligations of the company SCEA Domaine de la Flaguerie – Les Vergers de Ducy and its client in the context of the sale of the following goods: cider production and local products.

Any service performed by the company SCEA Domaine de la Flaguerie (Les Vergers de Ducy) therefore implies the buyer’s unreserved acceptance of these general conditions of sale.

The Domaine de la Flaguerie undertakes, in accordance with the CCRIE charter, to respond to any request or complaint made by its customers.

Our general conditions of sale specify the conditions for all orders, payments, deliveries, returns and refunds.

Any product order placed by a buyer with “SCEA DOMAINE DE LA FLAGUERIE – LES VERGERS DE DUCY” will imply the final and irrevocable agreement of the customer to all of the general conditions of sale presented below. The prices indicated are inclusive of VAT (all taxes included) for Metropolitan France.

1. Order taking methods

A-1 The buyer can place an order with La SCEA Domaine de la Flaguerie – Les Vergers de Ducy and pay for his purchases:

A-2 Orders placed through one of the four approaches presented above bind the buyer irrevocably.

1. Price

C-1 The sale prices of the products are expressed by default in Euros, in all current taxes including VAT.

C-2 The company SCEA Domaine de la Flaguerie – Les Vergers de Ducy grants itself the right to modify the prices of its products at any time. However, it undertakes to invoice the goods ordered at the prices indicated at the time of the order.

The sale price retained for the purchase of a product corresponds to that observed online:

C-3 The selling price of the product is understood to mean the price excluding any delivery costs.

C-4 Delivery costs are the responsibility of the buyer and are invoiced in addition to the selling price of the products. 1. Payment terms

D-1 All purchases made at La SCEA Domaine de la Flaguerie – Les Vergers de Ducy are payable when ordering. No product may be shipped to a buyer if the latter has not previously paid 100% of the selling price including tax of the product as well as any related delivery costs.

D-2 The SCEA Domaine de la Flaguerie – Les Vergers de Ducy reserves the right to suspend all processing of orders and all deliveries in the event of refusal of authorization for payment by credit card from officially accredited bodies or in the event of non-payment.

The SCEA Domaine de la Flaguerie – Les Vergers de Ducy specifically reserves the right to refuse to make a delivery or to honor an order from a buyer who has not fully or partially paid for a previous order or with whom a Payment dispute would be under administration.

1. Delivery

Delivery is made:

• either by direct delivery of the goods to the buyer,
• either by sending a notice of availability in store to the attention of the buyer,
• either at the place indicated by the buyer on the order form.

E-1 Products purchased from SCEA Domaine de la Flaguerie – Les Vergers de Ducy can only be delivered in Metropolitan France. Any other destination will be subject to a reassessed estimate of transport costs.

E-2 The delivery time indicated when registering the order is given for information only and is in no way guaranteed. Any reasonable delay in the delivery of the products cannot give rise to the benefit of the buyer to the allocation of damages or to the cancellation of the order.

E-3 Delivery is considered to have been made from the date of the first presentation of the goods to the buyer. The delivery of the goods will be made against signature by the receiving customer of a delivery slip.

The customer has the obligation to check the conformity and the good condition of the goods delivered at the time of delivery, before signing the delivery slip. The risk of transport is fully borne by the buyer.

E-4 In the event of goods missing or damaged during transport, the buyer must make all the necessary reservations on the delivery note for the said goods. In case of breakage or missing goods, the customer can refuse the goods to the carrier and contact us.

The contact details of the carrier will appear on the delivery note or on the order confirmation or on the invoice.

1. Delivery errors

F-1 The customer must formulate with the SCEA Domaine de la Flaguerie – Les Vergers de Ducy, on the same day of delivery or at the latest within 5 working days following delivery, any complaint of error of delivery and/or non-conformity products in kind or in quality compared to the indications appearing on the delivery note.

1. Withdrawal clause

G-1 Legal guarantee of conformity: The SCEA Domaine de la Flaguerie – Les Vergers de Ducy is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery (article L.217-4 of the consumption). This guarantee applies for two years from the delivery of the goods (article L.217-2 of the consumer code).

G-3 The costs of returning products under the withdrawal clause are the responsibility of the buyer.

• If the product has been received and if it meets the conditions required to obtain a refund (complete product, packaged and in perfect condition for resale)
• Or if the product has suffered damage, if it is incomplete, or if the packaging has been degraded

1. force majeure

The responsibility of the company SCEA Domaine de la Flaguerie (Les Vergers de Ducy) cannot be implemented if the non-execution or the delay in the execution of one of these obligations described in these general conditions of sale arises from a case of force majeure.

As such, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.

1. Court of competent jurisdiction

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.

Failing amicable resolution, the dispute will be brought before the Commercial Court of Caen.
